-  Location of investment project: Binh Duong Province, adjacent to:

+  Adjacent to VĐ02 road (22m right at National Highway 1), Dong Hoa residential area – Di An commune – Binh Duong province to the north.

+ To the east, it borders the University of Medicine – Hospital of VNU HCMC. HCM.

+  Adjacent to the vacant land (planned to build a research institute of VNU-HCMC) to the west and south.

1.1.3. Current land use status of the project

The area of the land area for the project is 5 hectare. In particular, the current land use status of the land is mostly unused vacant land.

The land for the project is under the general management of the entire VNU-HCM planning area according to Decision No. 4563/QD-CT dated November 13, 2003 of the People's Committee of Binh Duong province V/v land acquisition of organizations, households and individuals in Dong Hoa commune, Binh An commune, Di An district,  Binh Duong province, assigned to The National University of Ho Chi Minh City to conduct site clearance compensation according to the detailed planning.

1.1.4.Capacity, technology and production products of the investment project

1.1.4.1. Capacity of investment projects

Project land area: 5 ha.

Capacity scale: general hospital construction, total scale of 500 beds, partial investment divided into 3 stages:

  • Phase 1: Scale: 100 beds;

  • Phase 2: Scale: 250  beds (Invest 150 more beds);

  • Phase 3: Scale: 500 beds (Investment in 250 more beds).

Process Explanations:

Patients come to the receiving counter to declare all necessary information and choose medical examination and treatment services such as: Regular examination, service examination, examination with health insurance card. The patient enters the examination registration counter corresponding to the selected service to carry out the medical examination and treatment registration procedure.

The patient makes payment for the examination without a health insurance card and travels to the appropriate specialty clinics under the guidance of the appropriate specialty clinic staff under the guidance of the staff to the designated clinic for the doctor to perform the physical examination. If the Doctor does not prescribe a test or X-ray, the patient takes the medicine and leaves.

For cases where the Doctor prescribes tests / ultrasound/MRI or X-rays, the patient pays the corresponding costs and follows the technical indications of the Doctor.

After waiting for the results of the test/ultrasound/MRI or X-ray, the patient returns to the clinic for consultation. It is possible that the patient will take the drug out for treatment and re-visit if available or be admitted to the hospital to treat the patient from the hospital discharged or transferred to the hospital at the request of the Doctor if any.

1.1.5. Products of investment projects

Health care and disease treatment for people in the province and neighboring Binh Duong province.

1.1.6. Raw materials, fuels, materials, electricity, chemicals used, electricity and water supply of investment projects

1.1.6.1. Raw materials, fuels, materials

When the project comes into operation, every year the demand for chemicals and consumables for the medical examination and treatment process is relatively large with many different types of items. In which, consumable materials and chemicals are mainly divided into the following basic groups:

-  Bandages, cotton, medical gauze.

-  Syringes and suction pumps of all kinds.

-  Blood pressure meter, stethoscope.

-  Sutures, hemostatic material.

-  Knives, pincers, pliers, scissors and surgical instruments.

-  Infusion wires, lug conductors, sond types, types of connecting wires.

-  Surgical gloves, examinations, tests have been sterilized, not sterilized.

-  Cellular, biochemical, hepatitis, TB culture, TB test, blood type and other testing chemicals.

-  X-ray film and supplies and chemicals used for X-ray machines.

-  Other types of medical supplies.

-  Medicines, pharmaceuticals of all kinds.

The above sources of consumable materials and chemicals are expected to be purchased from domestic and foreign manufacturers.

1.1.6.2. Electricity demand

The power supply for operation is taken from the national grid, then lowered (through the substation) and put into use for operation and daily life. Serving mainly for medical examination and treatment areas, work areas and public lighting.

In addition, to ensure the prevention of power outages, the project will equip additional backup generators.

Inpatient medical examination and treatment water

Water supply for medical examination and treatment activities from departments, water for the living purposes of patients, relatives and visitors is calculated according to Standard 52 BC - CTYT 0041: 2005 - Design standards of district hospitals - Industry standards: the amount of water supplied to the hospital for 1 hospital bed is q = 1,000 liters / bed (including the amount of water used for the process of examination and treatment of diseases in functional departments, domestic wastewater of patients, water used for the process of washing clothes, cleaning disease rooms, ...).

1.3. Legal grounds for implementing environmental dossiers of the project

1.3.1. In case the project is subject to the preparation of an environmental impact assessment (EIA) report

  • For the project “VNU HCMC International Hospital” only have to set up an EIA in case: The project has invested  in a hazardous medical  waste treatment system  such as incinerator or autoclave.

  • For projects with hazardous waste treatment items, regardless of the  scale of treatment capacity, all projects must implement EIA approved by the Ministry of Natural Resources and Environment.  

Base:

  • Clause 1, Article 30 of the Law on Environmental Protection No. 72/2020/QH14 adopted by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020 stipulates that subjects must carry out environmental impact assessment.

  • Section No. 9 of the Government's Appendix II  specifies  the list of types of production, business and services that pose a risk of polluting the environment.

  • Section No. 2 of Appendix III of Decree No. 08/2022/ND-CP dated January 10, 2022 stipulates the list of group I investment projects with a high risk of adverse impacts on the environment specified in Clause 3, Article 28 of  the Law on Environmental Protection.

  • Article 35 of the Law on Environmental Protection No. 72/2020/QH14 adopted by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020 stipulates the competence to appraise environmental impact assessment reports.

The process of implementing environmental legal dossiers in case the project “VNU International Hospital HO CHI MINH CITY” is subject to EIA is as follows:

1.3.1.1. EIA implementation

a) Time of establishment of EIA

The environmental impact assessment is carried out simultaneously with the process of preparing a feasibility study report or equivalent document with the feasibility study report of the project.

  • Pursuant to: Clause 1, Article 35 of the Law on Environmental Protection No. 72/2020/QH14 was approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020 stipulating the implementation of environmental impact assessment.

b) EIA appraisal authority

The EIA of theproject "VNU HCMC International Hospital" (in case the project has investment in hazardous medical waste treatment system) is under the appraisal authority of the Ministry of Natural Resources and Environment.

  • Pursuant to Point a, Clause 1, Article 35 of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th session of the National Assembly of the Socialist Republic of Vietnam on 17/11/2020, the competence to appraise environmental impact assessment reports.

c) Contents of EIA report

  • Pursuant to Form No. 04 Appendix II  of Circular No. 02/2022/TT-BTNMT dated January 10, 01 of the Minister of Natural Resources and Environment

d) Legal dossiers and technical documents to be prepared when preparing EIA

  • Copies of documents of competent authorities on decisions on investment policies, investment registration certificates, decisions on adjustment of investment policies, certificates of adjustment of investment registration.

  • Decision on approval of project planning.

  • Land legal documents of the project if any: Land lease contract/Land allocation decision/Land use right certificate,...

  • Copies of other legal documents related to the project: Agreements on the connection of electricity, water supply, drainage, and transportation systems,...

  • Drawings of the overall site of wastewater drainage (showing pipes, dimensions, pre-treated wastewater collection manholes and the location of post-treatment drainage connection).

  • Pursuant to Form No. 04, Appendix II of Circular No. 02/2022/TT-BTNMT dated January 10, 2022 of the Minister of Natural Resources and Environment.

đ) EIA implementation process

1) Surveying, collecting information and monitoring the quality of the background environment:

Carry out monitoring and measurement of the quality of environmental components that are likely to be directly affected by the project such as the air environment directly receiving the project's exhaust gas source, the surface water environment, the land environment of the wastewater receiving area of the project.

2) Write a report:

The content of the report structure is based on the provisions of Form No. 04, Appendix II  of Circular No. 02/2022/TT-BTNMT dated January 10, 01 of the Minister of Natural Resources and Environment.

3) EIA consultation:

  • Consultation through posting on the website.

  • Consultation by holding an opinion meeting.

  • Written consultation.

  • Pursuant to Article 26 of Decree No. 08/2022 /ND-CP dated January 10, 2022 stipulating consultation in environmental impact assessment.

4) Edit the EIA report:

Receive and explain the results of consultations and complete environmental impact assessment reports before submitting them to competent authorities for appraisal.

5) Submission of appraisal of EIA report:

A dossier of request for appraisal of an environmental impact assessment report includes:

  • Written request for appraisal of environmental impact assessment report (Pursuant to Form  No. 02, Appendix II  of Circular No. 02/2022/TT-BTNMT dated January 10, 2022 of the Minister of Natural Resources and Environment);

  • Environmental impact assessment report;

  •  Feasibility study report or equivalent document to the feasibility study report of the investment project.

  • Pursuant to Clause 1, Article 3and 4  of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020, the appraisal of environmental impact assessment reports.

6) Payment of EIA report appraisal fee:

Investment project owners are responsible for paying fees for appraisal of EIA reports according to the notice of payment of fees by the appraisal agency, the Ministry of Natural Resources and Environment.

The appraisal fee payment is determined based on the total investment capital of the investment project.

  • Pursuant to Circular No. 56/2018 /TT-BTC dated June 25, 2018 of the Minister of Finance.

7) EIA report determination:

  • Pursuant to   Clause 3, Clause 4, Clause 6, Clause 7,  Article 34  of the Law on Environmental Protection No. 72/2020/QH14, approved by the National Assembly of the Socialist Republic of Vietnam XIV, the 10th session on 17/11/2020 stipulating  the appraisal of environmental impact assessment reports.

8) Editing, supplementing and completing EIA reports:

The investment project owner shall coordinate with the consultant to supplement, revise and complete the EIA report at the request of the appraisal agency.

  • Pursuant to Clause 5,  Article 3and 4  of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020, the appraisal of environmental impact assessment reports.

9) Submit dossiers of  completion of EIA reports to the Ministry of Natural Resources and Environment for approval.

10) The Ministry of Natural Resources and Environment shall issue a decision approving the results of appraisal of environmental impact assessment reports.

  • Pursuant to Clause 9,  Article 3and 4  of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020, the appraisal of environmental impact assessment reports.

1.3.1.2. Implementation of dossiers of application for environmental permits (GPMT)

a) Subjects must have environmental permits

  • Pursuant to Clause 1, Article 39 of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020, subjects must have environmental permits.

b) Time to apply for environmental permits

When the project completes the construction of waste treatment works for the entire project or for each investment divergence of the project and before the project commissions the waste treatment works.

Base:

  • Point a Clause 2 Article 42 of the Law on Environmental Protection No. 72/2020/QH14 adopted by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020 stipulating  the time of issuance of environmental permits.

  • Point a Clause 2 Article 29  of the Government's  Decree No. 08/2022/ND-CP dated January 10, 2022.

c) Authority to grant environmental permits

Theproject “VNU HCMC International Hospital” (in case the project involves investment in a hazardous medical waste treatment system) is under the authority of the Ministry of Natural Resources and Environment to grant environmental permits.

  • Pursuant to Point a, Clause 1, Article 41 of the Law on Environmental Protection No. 72/2020/QH14 adopted by the National Assembly of the Socialist Republic of Vietnam XIV, the 10th session on 17/11/2020 stipulates the competence to appraise environmental impact assessment reports.

d) Contents of the report proposing to grant environmental permits

  • Pursuant to Appendix VIII  of Decree No. 08/2022/ND-CP dated January 10, 2022 stipulating  the Form of Report proposing to grant environmental permits of investment projects, a decision has been made approving the results of appraisal of environmental impact assessment reports before going into trial operation.

đ) Legal dossiers and technical documents to be prepared when making reports on proposals for granting environmental permits

  • Copies of business registration certificates, investment registration certificates or equivalent documents;

  • Land papers or copies of land lease contracts for the implementation of investment projects in accordance with the provisions of law;

  • Drawings of completion of  environmental protection works , works on prevention and response to environmental incidents in accordance with the provisions of law;

  • Certificates, certificates and accreditations of imported or commercialized synchronous waste treatment works and equipment;

  • Minutes of acceptance and handover of environmental protection works or other documents related to environmental protection works of investment projects (if any);

  • Sampling location diagram of the environmental monitoring program;

  • Documents on provincial planning, environmental zoning, load capacity of the environment have not been issued by competent state agencies;

  • A copy of the environmental impact assessment report and a copy of the decision approving the results of appraisal of the environmental impact assessment report of the project.

  • Basis of documents of the competent authority on the hazardous medical waste treatment system of the project;

  • Technical dossiers, design drawings, completion of systems and equipment invested in the treatment of hazardous medical waste and the storage of hazardous medical waste.

  • Instructions for safe operation of hazardous medical waste treatment vehicles and equipment.

  • Pursuant to Appendix VIII of Decree No. 08/2022/ND-CP dated January 10, 2022 stipulating the Form of Report proposing to grant environmental permits of private projects, a decision has been made to approve the results of appraisal of environmental impact assessment reports before going into trial operation.

e) Environmental permitsimplementation process

1) Survey, collect information, write reports

The report structure is based on Appendix VIII  of Decree No. 08/2022/ND-CP dated January 10, 2022 stipulating  the Form of report proposing to grant environmental permits of private projects that have decided to approve the results of appraisal of environmental impact assessment reports before going into trial operation.

2) Submit a dossier of application for environmental permits

A dossier of application for an environmental permit includes:

  • Written request for environmental permits (Pursuant to Appendix XIII  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022);

  • The report proposes the issuance of environmental permits;

  •  Decide to approve the results of appraisal of environmental impact assessment reports and accompanying environmental impact assessment reports.

  • Pursuant to Clause 1, Article 43  of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th National Assembly of the Socialist Republic of Vietnam on November 17, 2020,  stipulating the appraisal of environmental impact assessment reports.

3) Pay  the appraisal fee for GPMT:

Investment project owners are responsible for paying appraisal fees for gpmt according to the notice of payment of fees by  the licensing agency, the Ministry of Natural Resources and Environment.

  • Pursuant to Circular No. 02/ 2022/TT-BTC dated January 10, 01 of the Minister of Finance.

 4) Determination  of dossiers of application for GPMT: Report Preliminary environmental impact assessment Of the investment project Vnu hcmc international hospital project

Base:

  • Point b Clause 2, Clause 3 Article 43  of the Law on Environmental Protection No. 72/2020/QH14 was approved by the National Assembly of the Socialist Republic of Vietnam XIV, 10th session on 17/11/2020 stipulating  the appraisal of environmental impact assessment reports.

  • Clause 4 Article 29  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

5) Editing, supplementing and completing the GPMT proposal report:

The investment project owner shall coordinate with the consulting unit to supplement, revise and complete the report proposing to grant GPMT according to the written notice requesting correction and supplementation of the dossier of the Ministry of Natural Resources and Environment.

  • Clause 5 Article 29  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

6) Submit the dossier  of completion of the application for gpmt to the Ministry of Natural Resources and Environment for licensing.

7) The Ministry of Natural Resources and Environment issues environmental permits.

  • Pursuant to Clause 6 Article 29  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

1.3.1.3. Commissioning

The investor project owner is responsible for the trial operation of the waste treatment project simultaneously with the process of trial operation of the entire project or for each investment divergence in each phase.

a) Subjects subject to trial operation

  • Pursuant to Clause 3, Article 31 of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

b) Time of trial operation

  • After the investment project is granted an environmental permit by the agency (Ministry of Natural Resources and Environment) and the time for trial operation according to the environmental permit has been licensed.

  • In case the project changes the test operation plan according to the granted environmental permit, the investment project owner must notify the test operation plan and waste treatment works of the project to the licensing agency (Ministry of Natural Resources and Environment) and The Department of Natural Resources and Environment of Binh Duong province in advance. at least 10 days from the date of commissioning of the waste treatment works.

  • Pursuant to Clause 3, Clause 5, Article 31  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

c) Legal dossiers and technical documents to be prepared for trial operation

  • Completion documents accompanied by explanations of the operation process of waste treatment works;

  • Certificates, certifications and accreditations of imported or commercialized synchronous environmental treatment equipment if any;

  •  Samples of measurement and analysis of test operation of waste treatment works;

  • Documents of competent agencies approving changes and adjustments to environmental impact assessment reports of projects;

  • Minutes of acceptance and handover of waste treatment works or other documents related to waste treatment works;

  • Log of operation of waste treatment works;

  • Hazardous waste documents.

  • Pursuant to Appendix XV of the  Government's Decree No. 08/2022  /ND-CP dated January 10, 2022 stipulating  the Form of Report on proposal for environmental permits of private projects, a decision has been made to approve the results of appraisal of environmental impact assessment reports before going into trial operation.

d) Process of commissioning

1) Notification of test operation plan

In case the project changes the test operation plan according to the granted environmental permit, it must notify the test operation plan and waste treatment works of the project to  the licensing agency (Ministry of Natural Resources and Environment and Department of Natural Resources) and Environment of Binh Duong province at least 10 days in advance. date of commissioning of waste treatment works.

  • Pursuant to Clause 3, Clause 5, Article 31  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

  • Form No. 43 of Circular No. 02/2022/TT-BTNMT dated January 10, 2022 of the Minister of Natural Resources and Environment.

2) Commissioning

  • The investment project owner shall coordinate with organizations qualified to operate environmental monitoring services to carry out waste monitoring during trial operation according to the waste monitoring plan, evaluate the treatment efficiency of waste treatment works and equipment granted in the environmental permit.

  • Waste monitoring during trial operation is guided in Article 21 of Circular No. 02/2022 /TT-BTNMT dated January 10, 2022 of the Minister of Natural Resources and Environment.

  • Have an operation logbook, fully record information of the trial operation of waste treatment works, fully record the volume of hazardous waste of the medical hazardous waste treatment system.

  • During the trial operation of the project's waste treatment works, if the waste discharged into the environment does not meet the environmental technical regulations on waste, the investment project owner must take the following measures: (Pursuant to Clause 8 Article 31  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022).

- Stop the operation or reduce the capacity of the investment project to ensure that existing waste treatment works can handle the generated waste in accordance with environmental technical regulations on waste and environmental permits;

  • Review waste treatment works, equipment, operation procedures of waste treatment systems to identify the causes of pollution and provide solutions; renovate, upgrade and build additional (if any) waste treatment works to meet the requirements of environmental protection as prescribed;

  • In case of causing environmental incidents or polluting the environment, the investment project owner must immediately stop the trial operation and promptly report to the environmental licensing agency for guidance on solving; in case the environmental permit-granting agency is the Ministry of Natural Resources and Environment, it must send more to the provincial-level specialized environmental protection agency to coordinate in solving environmental issues; be responsible for overcoming environmental incidents, compensating for damages and being handled for violations in accordance with the provisions of law;

  • Plan for trial operation of waste treatment works or each item of waste treatment works that do not meet environmental technical standards on waste for re-operation. The order, procedures and time of re-commissioning of the waste treatment works shall be carried out as the first test operation.

3) The environmental permit-granting agency shall establish a field inspection team, conduct measurements, take and analyze samples of waste discharged into the environment during the trial operation of the project.

4) The investor shall report on the results of trial operation of the project's waste treatment works

Form of report on the results of trial operation of waste treatment works of the project based on Appendix XV of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

1.3.1.4. Periodic environmental protection reports

a) Subjects subject to environmental protection work report

  • Pursuant to Clause 7, Article 66 of Circular No. 02/2022/TT-BTNMT dated January 10, 2022 of  the Ministry of Natural Resources and Environment.

b) Time of implementation and submission of environmental protection work report

  • The reporting period for environmental protection is from 01 to 31/12 every year.

  • Time to submit environmental protection report: Submitted before 05/01 of the next year.

  • Pursuant to Clause 7, Article 66 of Circular No. 02/2022/TT-BTNMT dated January 10, 2022 of  the Ministry of Natural Resources and Environment.

c) Contents of environmental protection reports

  • Pursuant to Appendix VI Form 05.A Circular No. 02/2022/TT-BTNMT dated January 10, 01 of the  Ministry of Natural Resources and Environment.

d) Agencies receiving reports on environmental protection work

Investment project owners send environmental work reports to agencies:

  • Environmental Licensing Authority (Ministry of Natural Resources and Environment)

  • Department of Natural Resources and Environment of Binh Duong Province

  • People's Committee of Di An City

  • Pursuant to Point a Clause 5 Article 66 of Circular No. 02/2022/TT-BTNMT dated January 10, 01 of the  Ministry of Natural Resources and Environment.

1.3.2. In case the project is not subject to EIA report and subject to EIA

The project “VNU HCMC International Hospital” does not invest  in a hazardous medical waste treatment system, the project does not have environmentally sensitive elements specified in Clause 4 Article 25  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022.

The project scale based on the total project investment capital is classified according to the criteria prescribed by the law on public investment:

  • Case 1: The project with an investment of VND 800 billion or more belongs to a group A project.

  • Case 2: The project has an investment of VND 45 billion to less than VND 800 billion under a group B project.

  • Pursuant to Clause 5, Article 8, Clause 4, Article 9 of  the Law on Public Investment: 39/2019/QH14 was approved by the 7th National Assembly of the Socialist Republic of Vietnam on June 13, 2019.

Classification of investment projects according to environmental criteria: In case the total investment capital of the project is in group A or group B, the project belongs to group II investment projects.  The project "VNU HCMC International Hospital" is subject to an environmental permit under the environmental licensing authority of the Provincial People's Committee.

Base:

  • Section No.  2 of Appendix IV of the Government's  Decree No. 08/2022  /ND-CP dated January 10, 2022 stipulates the list   of group I I investment projects with risks of  adverse impacts on the environment specified in Clause 4,  Article 28 of the Law on Environmental Protection.

  • Clause 1, Article 39 of the Law on Environmental Protection No. 72/2020/QH14 was approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020 stipulating  the appraisal of environmental impact assessment reports.

  • Clause 3, Article 41 of the Law on Environmental Protection No. 72/2020/QH14 was approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020 stipulating  the appraisal of environmental impact assessment reports.

The process of implementing environmental legal dossiers in case the project "VNU International Hospital HO CHI MINH CITY" is not subject to EIA and subject to gpmt is as follows:

1.3.2.1. Implementation of dossiers of application for environmental permits (GPMT)

a) Subjects must have GPMT

  • Clause 1, Article 39 of the Law on Environmental Protection No. 72/2020/QH14 was approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020 stipulating  the appraisal of environmental impact assessment reports.

b) Time to apply for GPMT

Investment projects must make dossiers of application for gpmt before being issued by competent state agencies with regulations:

  • Approving feasibility study reports for public-private partnership investment projects;

  • Conclusion of appraisal of feasibility study report for construction investment projects;

  • Investment decisions for investment projects are not subject to: Approval of feasibility study reports for investment projects in the form of public-private partnership and Conclusion of appraisal of feasibility study reports for construction investment projects.

  • In case the investment project is not subject to appraisal of the feasibility study report by a specialized construction agency in accordance with the law on construction, it must have a construction permit before being granted or adjusted by a competent state agency.

  • Pursuant to Point b Clause 2 Article 42 of the Law on Environmental Protection No. 72/2020/ QH14 approved by the National Assembly of the Socialist Republic of Vietnam XIV, the 10th session on 17/11/2020 stipulates the time of issuance of environmental permits.

  • Clause b Clause 2 Article 29 of Decree No. 08/2022 /ND-CP dated January 10, 2022.

c) Competence to grant GPMT

Theproject "VNU HCMC International Hospital" (in case the project does not invest in a hazardous medical waste treatment system, the total investment capital of the project belongs to group A or group B, the project belongs to the group II investment project ) under the environmental license authority of the People's Committee of Binh Duong province.

  • Pursuant to Point a, Clause 3, Article 41 of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th National Assembly of the Socialist Republic of Vietnam on 17/11/2020, the competence to appraise environmental impact assessment reports.

d) Contents of the report proposing to grant gpmt

  • Pursuant to Appendix IX of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022 stipulating the Form of report proposing to grant and reissue environmental permits of group II investment projects that are not subject to environmental impact assessment.

đ) Legal dossiers and technical documents to be prepared when making reports on proposals for granting gpmt

  • Copies of business registration certificates, investment registration certificates or equivalent documents;

  • Basic design drawings or construction design drawings of environmental protection works, environmental incident prevention and response works accompanied by explanations of the operation process of waste treatment works;

  • Certificates, certificates and accreditations of imported or commercialized synchronous waste treatment works and equipment (if any);

  • The results of measurement and analysis of environmental samples are at least 03 surveys;

  • Inspection and calibration slips of agencies and organizations with functions for automatic and continuous monitoring equipment of installed waste (if any);

  • Sampling location diagram of the environmental monitoring program;

  • Documents on provincial planning, environmental zoning, load capacity of the environment shall be promulgated by competent state agencies.

  • Pursuant to Appendix IX of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022 stipulating the Form of report proposing to grant and reissue environmental permits of group II investment projects that are not subject to environmental impact assessment.

e) Process of implementation of GPMT

1) Survey, information collection, background environment monitoring

The results of measurement, sampling, analysis and assessment of the current state of the environment in the receiving area of the project shall be carried out at least 03 surveys. The measurement, sampling and analysis of samples must comply with the technical process of environmental monitoring.

2) Write a report

The report structure is based on Appendix IX  of the Government's Decree No. 08/2022/ND-CP dated January 10, 2022 stipulating that the report form proposing to grant and reissue environmental permits of group II investment projects is not subject to environmental impact assessment.

3) Submit a dossier of application for a GPMT

A dossier of application for an environmental permit includes:

  • Written request for environmental permits (Pursuant to Appendix XIII  of Decree No. 08/2022/ND-CP dated January 10, 2022);

  • The report proposes the issuance of environmental permits;

  • Feasibility study report or equivalent document to the feasibility study report of the project.

  • Pursuant to Clause 1, Article 43  of the Law on Environmental Protection No. 72/2020/QH14, approved by the 10th National Assembly of the Socialist Republic of Vietnam on November 17, 2020,  stipulating the appraisal of environmental impact assessment reports.

4) Payment of gpmt appraisal fee :

Investment project owners are responsible for paying appraisal fees for gpmt according to the notice of payment of fees by  the licensing agency, the Department of Natural Resources and Environment – People's Committee of Binh Duong province.

  • Pursuant to Resolution No.  17/2021/NQ-HDND dated December 10, 2021   of the  People's Council of Binh Duong province.
